is it possible to still get factions pre-order anywhere? if not, is it legal to buy one on a place like ebay?

You're not going to find one still instock at retailer; they throw the left overs in the trash after the promotion is over. It's perfectly legal to buy one off ebay; you just can't buy any existing accounts.
